Matthew Hays McCoy

Matthew Hays McCoy is a South Dakota civil litigation attorney and founder of McCoy PC, serving clients throughout the Seventh Judicial Circuit and the U.S. District Court for the District of South Dakota. His practice focuses on complex civil litigation, business disputes, construction litigation, trust and estate matters, and constitutional defense. Matthew has successfully dismissed civil actions involving self-defense claims, obtained protective orders in high-profile class litigation, and litigated significant breach-of-contract and property disputes. He is known for strategic motion practice and persuasive written advocacy at every stage of litigation through trial and before the South Dakota Supreme Court. His litigation practice includes:

  • Complex civil litigation and summary judgment practice
  • Construction defect and breach-of-contract cases
  • Class action litigation and declaratory judgment actions
  • Trust disputes and fiduciary litigation
  • Probate litigation and creditor rights
  • Constitutional and statutory defenses in criminal proceedings

He also represents clients in criminal matters involving constitutional defenses, statutory immunity, and complex pretrial motion practice.
